BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
THE DELAWARE AND HUDSON RAILROAD CORPORATION
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the effective Agreement when, subsequent to September 1, 1951, it assigned employed of the Signal
Department to paint signal poles, telephone boxes, number plates,
control boxes, signal cabins, etc., on the Carrier's Pennsylvania
Division;
(2) The same number of Painters, taken in seniority order
on the Pennsylvania Division, be allowed pay at their regular
straight time rates for an equal number of man-hours as were consumed by Signal Department employes in the performance of the
work referred to in part (1) of this claim.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of May 27,
1957, the complainant party addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
