PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
THE CHESAPEAKE AND OHIO RAILWAY COMPANY
(Chesapeake District)
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood:
(a) That the Carrier violated the terms of the effective Clerical
Agreement when it established position of Special Report Clerk
Position No. A-12, in the office of Superintendent of Freight Transportation, General Office District, Richmond, Virginia, and assigned
thereto hours of 2:00 A. M. to 10 :00 A. M. on four days each week,
and hours of 7:15 A. M. to 3:15 P. M. on the fifth day, and
(b) That title of the position be changed to conform to the
duties assigned and the rate of pay adjusted from $426.16 per month
to $441.57 per month retroactive 60 days from date of claim, and
(c) That Mr. J. F. Powell, Jr., his substitutes and/or successors
be additionally compensated in accordance with the provisions of Rule
34 for all time worked before 6:00 A. M., retroactive 60 days from
date of claim, and continuing until violation is corrected, also
(d) That Mr. Powell be additionally compensated under the
applicable rules for each day he was arbitrarily rearranged from his
regular assignment to fill vacancies on position of Night Report
Clerk, A-20, retroactive 60 days from date of claim and continuing
until violation is corrected.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of June 11, 1957,
the complainant party addressed a formal communication to the Secretary of
the Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Case dismissed.
