STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood:
(a) That the Carrier violated the Agreement when on June 5
and 6, July 31, and August 1 1956, it rearranged Mr. J. H. Blankenship, the occupant of Night Report Clerk Position No. A-20 to
position of Special Report Cleric Position A-12.
(b) That the Carrier violated the Agreement when on July
15, 16, 22, and 23 1956;, it rearranged Mr. J. H. Blankenship, the occupant of Night Report Clerk, Position A-20 to position of Night
Report Clerk A-7.
(c) That the Carrier shall now compensate Mr. J. H. Blankenship an additional day's pay at the pro rata rate of his regularly
assigned position ($19.83) for the dates stated in parts "a" and
"b" above, plus the difference between the rate of position worked, if
higher than his own rate, and what he was actually paid.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of June 71, 1957,
the complainant party addressed a formal communication to the Secretary of
the Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Case dismissed.
