STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violated and continues to violate the terms
of the effective Clerical Agreement by requiring Night Report
Clerk, Mr. J. H. Blankenship, Position No. A-20, to suspend work
on his regular assignment each Tuesday and Wednesday, to provide
rest day relief for position of Night Report Clerk A-7, in the office
of Superintendent of Freight Transportation, General Office District,
Richmond, Virginia, held by Mr. J. A. Davis, and
(b) That Mr. Blankenship shall now be compensated in accordance with the provisions of Rule 24 (c), and at the higher rate for
each such Tuesday and Wednesday he is arbitrarily rearranged from
his regular assignment, retroactive 60 days from date of claim and
continuing unt1 corrected, also
(c) That Mr. J. A. Davis be additionally compensated for 8
hours at the punitive rate of his regular assignment account failure
to call him for service performed on his rest days, retroactive 60 days
from date of claim and continuing until corrected.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of June 11,
1957, the complainant party addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
