PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
NORFOLK SOUTHERN RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Norfolk Southern Railway, that:
1. The Carrier violates the agreement between the parties when
it fails and refuses to apply said agreement as to rates of pay, rules
and working conditions to employes and positions subject to the
agreement, viz. ,
Operator-Leverman -Tidewater Junction, Va.
Agent-Telephoner -Virginia Beach, Va.
2. The Carrier shall now be directed to apply the Agreement
to these employes; that the positions be placed in the Agreement at
their prevailing rates of pay; that the seniority and other provisions
of the Agreement be applied to said employes including extension
of seniority and promotion rights to positions on the Northern
District; and that seniority and promotion rights of employes on the
Northern District be extended to the positions at Tidewater Junction
and Virginia Beach.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing was waived and under date of July 15, 1957, the parties
jointly addressed a formal communication to the Secretary of the Third
Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Claim dismissed.
