PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
ILLINOIS CENTRAL RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that-
(a) Carrier violated the Clerks' Agreement at Louisville
Kentucky, when on March 16, 1953, it required or permitted, and
continued to require or permit, employes of a trucking firm, who
bold no seniority rights under the Clerks' Agreement with the Carrier,
to come into the freight house to check and handle freight from
various locations on the wareroom floor, using Carrier's two-wheeled
trucks to move freight into Contractor's Motor trucks.
(b) Extra Clerk J. S. Wathen and/or his successor, if there be
any, be compensated for wage loss sustained representing a day's
pay at pro rata rate retroactive to March 16, 1953 and forward to
date the violation is corrected. (Pro rata rate of position $13.52
per day.)
NOTE: Reparation to be determined by joint check of Carrier's
payroll and other records.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of July 12, 1957,
the complainant party addressed a formal communication to the Secretary of
the Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Case dismissed.
