STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the provisions of Rules 1, 2, 3, 66
and 70 of the January 1, 1938 Agreement, hereinafter quoted,
when it abolished Ticket Clerk Position No. 4294, at North Miami,
and turned the function of selling tickets, quoting train and
ticket information, keeping ticket accounts and records, checking,
receiving and delivering baggage over to a supervisory agent and
two telegraphers to perform, and that as a result of this violation
(2) Ticket Clerk R. H. Schnarr and his successors be compensated for all monetary losses suffered from May 1, 1956 until
the violation is corrected.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party: and
That no hearing thereon has been held, and under date of July 22,
1957, the complainant party addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
