ORDER OF RAILWAY CONDUCTORS AND BRAKEMEN
CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC RAILROAD
COMPANY
STATEMENT OF CLAIM: The Order of Railway Conductors and
Brakemen, Pullman System, claims for and in behalf of Conductor F. W. Kuss,
Milwaukee District, that:
1. Under date of April 21, 1956, train No. 5 covered by an
Operation of Conductors form was operated without the services of a
Parlor Car Conductor from Chicago, Ill., to Minneapolis, Minn.
2. Because of this violation, we now ask that Conductor Koss,
who was available and willing to perform the work on train No. 5, be
credited and paid not less than one and one-quarter days under
applicable rules, for the trig Chicago to Minneapolis, and for a deadhead trip Minneapolis to Chicago.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of October 9,
1957, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
