STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that-
(a) Carrier violated rules of the Clerks' Agreement at the
Freight Agency, Pans, Illinois, when on Tuesday, January 3,
Mondays January 9, 16, 23 30, ebruary 6, 13 20, and 27, 1956, it
unilaterally assigned work theretofore attached to clerical positions
to be performed by employes of Carrier occupying positions that are
not included within the Scope Rule of its Agreement with the Brotherhood, revised as of February 1, 1954.
(b) I. M. Partelow, clerk at Pana, be compensated for wage
losses sustained representing two hours' pay at punitive rate on the
dates named in part (a) of claim.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of October 28,
1957, the complainant party addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Case dismissed.
