STATEMENT OF CLAIM: Appeal to the Third Division, National Railroad Adjustment Board, by Hudson & Manhattan Railroad Company, Herman T. Stichman, Trustee (the "Carrier") for a final award affirming the Carrier's determination that employes represented by American Train Dispatchers Association ("ATDA") are not entitled to pay for time furloughed pursuant to Bulletin and letter dated March 27, 1957 as a result of a strike of nonoperating unions closing Carrier's operations.




That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That no hearing thereon has been held, and under date of November 8, 1957, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
