PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
ILLINOIS TERMINAL RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the Committee of The Order of
Railroad Telegraphers on the Illinois Terminal Railroad, that:
1. Carrier violated and continues to violate the agreement between the parties when, on April 9, 1956 and subsequent dates, at
Edwardsville, Illinois, it requires and permits employes not covered
by the agreement to handle train orders.
2. Carrier be required to compensate the senior idle employe,
extra in preference, in the amount of one day's pay on each day of
such violation commencing April 9, 1956 and continuing thereafter
until the violation is corrected.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of November 29,
1957, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Claim dismissed.
