STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the rules of the Clerks' Agreement
when it refused to allow Earl C. Goble compensation while absent
from duty account of illness.
(2) That Earl C. Goble be allowed pay for seventeen (17)
working days, namely, January 16, 17, 18, 21, 22, 23, 24, 25, 28,
29, 30 and 31 and February 1, 4, 5, 6 and 7, 1957, at the rate of
$19.30 per day, the rate of his regular assigned position.

FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of November 26,
1957, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
