STATEMENT OF CLAIM: Claim of Dining Car Employees Union, for and on behalf of W. Osborne, C. Rucker, John Carson, T. P. Darby, John Emmons, W. J. Ashby, E. C. Wise, John Allen, H. J. Thorne, E. Swanson C. . Ivory, F. Dodson, A. Goines, R. Porter, Ned Hamilton, I. Austin, J. Hardy, C. Abdin, Robert Braxton, P. Hollins, L. White, T. Burger, J. Williams, and other employes similarly situated, that they shall be paid the difference between what they were paid and what they should have been paid had their assignments on Trains 1 and 92 not been disturbed.


This time claim is effective from the date Dining Car Service was abolished on Trains 1 and 92 up to and including this date and hereafter until their assignments shall have been restored.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and


That no hearing thereon has been held, and under date of February 10, 1958, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
