STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood
(1) That the Carrier violated the agreement between the
Brotherhood and the Carrier effective August 15, 1939 as reprinted
May 1, 1955, when on June 25, 1956 and continuing thereafter, it
permitted an officer of the Carrier, Auditor of Accounts Mr. A. R.
Hammond, to perform advance preparatory work of pricing of stock
books for the annual inventory, making extensions and tota:ing
monies therein, which is detail work within the scope of the effective
agreement belonging to employes covered thereby; and
(2) That the Carrier shall now be required to compensate R. H.
Clemens, Assistant Accountant, for eight (8) hours' pay at the rate
of $3.354 per hour, for Saturday, June 30 and Sunday, July 1, 1956,
and for each subsequent Saturday and Sunday during which this
work was performed by the Auditor of Accounts.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of July 2, 1958,
the complainant party addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Claim dismissed.
