PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES

RAILROAD COMPANY
STATEMENT OF CLAIM:
This is a claim of the System Committee of
the Brotherhood that:
(a) Carrier violated and continues to violate the provisions of
the Clerks' Agreement by its action in removing from the scope of the
Clerks' Agreement the work involved in taking remittances from
various Freight Stations, Passenger Stations and Ticket Offices to the
banks in San Francisco, Oakland, Sacramento and any other city in
which this has occurred.
(b) The occupant of each position which formerly performed the
work of taking such remittances from his office to the bank is entitled
to and shall now be compensated for a minimum call for each day of
the violation since November 14, 1954 and continuing until the violation is corrected.
Note: In the event that those positions are no longer in
existence, then the compensation due shall be paid the occupant of the position who made the bank remittance form.
The employes entitled to the time claimed to be determined from a joint check of Carrier's time-rolls and reports.
FINDINGS:
The Third Division of the Adjustment Board, upon the
whole record and all the evidence, Hnds and holds:
That the Carrier and the Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as
approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and

That hearing thereon was waived by the parties and under date of September 2, 1958, the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which
request is
hereby granted.
AWARD
Case dismissed.
