BROTHERHOOD OF RAILROAD SIGNALMEN OF AMERICA
SOUTHERN RAILWAY COMPANY
STATE31ENT OF CLAIM:
Claim of the General Committee of the
Brotherhood of Railroad signalmen of America on the southern Railway Company et al. that:
(a) The Carrier violated the current Signalmen's Agreement
when it denied C. L. Kimbrell, Signalman in Foreman Grogan's gang,
the right to overtime work on September 21, 22, and 23, 1956.
(b) The Carrier now pay Signalman C. L. Kimbrell at his respective overtime hourly rate of pay for two (2) hours on September
21, 1956, ten (10) hours on September 22, 1956, and ten (10) hours
on September 23, 1956, a total of twenty-two (22) hours.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of October 22, 1958,
the complainant party addressed a formal communication to the Secretary of
the Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Case dismissed.
