THE NEW YORK CENTRAL RAILROAD (Eastern District)
(except Boston Division)
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the New York Central Railroad (Buffalo
and East), that:
1. Carrier violated agreement when on the 27th day of June
1955, it assessed against the record of J. A. Petell, discipline
"Fifteen days record suspension."
2. Carrier violated agreement when on the 27th day of June
1955, it assessed against the record of R. C. Pacific, discipline
"Fifteen days record suspension."
3. Carrier shall be required to clear the record of J. A. Petell
and R. C. Pacific of discipline assessed as aforesaid.
4. Carrier shall be required to compensate R. C. Pacific in the
sum of $89.97 for time lost and reimbursement of expenses in connection with attendance at hearing, Watertown, N. Y., on June 24,
1955, and suspension from assignment.
5. Carrier shall be required to compensate J. A. Petell in the
sum of $54.50 for time lost and reimbursement of expenses in connection with attendance at hearing, Watertown, N. Y., on June 24,
1955.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of October 28, 1958, the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting
withdrawal of
this case from
further consideration by the Division, which request is hereby granted.
