THE NEW YORK CENTRAL RAILROAD (Eastern District)

STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the New York Central System-Eastern
District, that:
1. Carrier violated Article 32 of the Telegraphers' Agreement
when it failed in the proper handling of a hearing in the case of
Charles G. Irving.
2. Carrier shall now remove all discipline assessed against
Charles G. Irving, clearing his record, and compensate him for his
lost time as a result thereof.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of October 28, 1958, the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
