STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that,
(a) The Carrier violated the Agreement when it failed to provide a vacation Relief Clerk to work the position of Roundhouse
Clerk while the occupant of the position, Mr. J. L. Burch, was on
vacation from July 1, 1957,
through July
10, 1957.
(b) Mr. James O. Mangum, Roundhouse Clerk, shall now be
compensated at tine and one-half the established rate of his own
position for July 1, 2, 3, 4, 5, 8, 9 and 10, 1957 (July 4 was a holiday).
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of November 6,
1958, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
