PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
CENTRAL OF GEORGIA RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of the General Committee of The Order
of Railroad Telegraphers on the Central of Georgia Railway that the Carrier
violated the agreement,
(1) When it failed and has since refused to advertise to employes subject to the agreement between the parties, the position of
Wire Chief, newly created in 'RA' telegraph office, Macon, Georgia,
on or about July 1, 1951.
(2) When it assigned to said Wire Chief position, Mr. F. L.
Rogers, an individual holding no seniority as telegrapher and possessing no rights under the agreement.
(3) The Carrier shall forthwith cause to be advertised to employes covered by the agreement on the district where established,
the Wire Chief position newly created in the telegraph office 'RA'
Macon, Georgia.
(4) Further, the Carrier shall cause to be placed on the proper
Telegraphers' seniority roster the name of F. L. Rogers as of the date
the said Rogers entered the services of the Carrier in the Telegraphers' class.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of November 24, 1958, the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
