PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
CENTRAL OF GEORGIA RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of .he General Committee of The Order
of Railroad Telegraphers on the Central of Georgia Railway, that:
(1) The Carrier violated the provisions of the Telegraphers'
Agreement when, commencing May 22, 1954 and terminating August
6, 1955, it required or permitted the regularly assigned occupant of
the Agent-Telegrapher's position at Cuthbert, Ga., to suspend work
on Saturday, the assigned rest day of the employe regularly occupying
this position, and relieved him with an employe not covered by the
current Telegraphers' Agreement and who held no seniority thereunder; and
(2) The Carrier shall now, by proper order of your Board, be
required to compensate the occupant of the agent-telegrapher's position at Cuthbert, Ga., commencing May 22, 1954 and terminating
August 6, 1955, for each Saturday in accordance with the provisions
of Article 7, Section 1, paragraph (m), he has been deprived of proper
payment due to the violative act of the Carrier.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of November 24, 1958, the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
