STATEMENT OF CLAIM:
Claim of the General Committee of The Order
of Railroad Telegraphers on the Central of Georgia Railway, that:
1. Carrier violated the agreement between the parties hereto
when and because on March 18, 31; April 13, 14, 19, 20, 25, 27, 28;
May 6 and 9, 1955, it directed Agent-Operator R. M. Yarbrough, at
Porterdale, Ga., to leave train orders and clearance cards in the waybill box for delivery to the crews of trains departing that station after
Yarbrough had been released from duty; and
2. R. M. Yarbrough shall be paid for each of the dates mentioned
in paragraph 1, an amount equivalent to a call (a minimum of two
hours at the overtime rate), because he was not permitted to complete the handling by making delivery of the orders and clearance
cards in question.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of November 24, 1958, the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
