PARTIES TO DISPUTE:

STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Central of Georgia Railway, that:
1. Carrier violated Article 1 of the Telegraphers' Agreement
when commencing on September 6, and continuing on September 7,
9, 10, 11, 12, 13, 14, 16, 17, 18, 19, 20, 21, 23, 24, 25, 26, 27, 28, 30,
October 1. 2 and 3, it caused, required or permitted Section Foreman
or Roadway Foreman, employes not covered by the Agreement, to
perfom the work of receiving, copying and delivering train line-ups
at Montezuma, Georiga, which work is by the Agreement solely and
exclusively reserved to employes covered by the Telegraphers' Agreement.
2. Carrier shall now compensate L. G. Downs, Agent-Telegrapher
at Montezuma, Georgia in accordance with Article 5, paragraph (c),
one call hour for each day mentioned above, and continuing thereafter so long as such work is performed by an employe not covered
by the Telegraphers' Agreement.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of November 24,
1958, the parties jointly addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
