STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Central of Georgia Railway, that:
1. Carrier violated the Telegraphers' Agreement when it required or permitted R. F. Dabbs to displace J. E. Lee as AgentOperator at Toomsboro, Georgia, effective June 24, 1957.
2. Carrier shall compensate J. E. Lee, $3.00 per day expenses
under Article 12, as well as pay for lost time and penalty rate for
Saturday and Sundays worked after June 24, 1957, and continuing
thereafter so long as J. E. Lee is held away from his temporary
assignment as Agent-Operator at Toomsboro.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon was waived by the parties. Under date of November
24, 1958, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
