STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on The Delaware, Lackawanna and Western
Railroad that:
1. The Carrier violated the Agreement between the parties
when it failed to apprise W. L. Wehr, in writing, of the precise
charges made against him in its notice of hearing dated June 21, 1957.
2. The Carrier further violated the Agreement when it assessed
a reprimand against the record of W. L. Wehr on charges not sustained at the hearing.
3. The record of W. L. Wehr shall be expunged of said reprimand, and
4. W. L. Wehr shall be compensated for a "call" ($6.81) for
time consumed in traveling from Montclair to Hoboken, New Jersey,
and while attending said hearing outside of regularly assigned hours.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of December 5,
1958, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
