READING COMPANY
STATEMENT OF CLAIM:
Claim of the system committee of the
Brotherhood that:
(1) The Carrier violated its agreement with the Brotherhood of
Maintenance of Way Employes when it assigned the work of repairing
the East Pier of Bridge 201/66 to outside forces without benefit of
negotiations and agreements with the Brotherhood of Maintenance
of Way Employes in connection therewith,
(2) Each Carpenter, Mason, Carpenter Helper and Mason Helper
holding seniority as such on the Shamokin Division be allowed pay at
their respective straight time rates of pay for an equal proportionate
share of the total number of man-hours consumed by the Contractor's
forces in performing the work referred to in Part (1) of this claim.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That no hearing thereon has been held and under date of December 26,
1958, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
