COMPANY
STATEMENT OF CLAIM:
Claim of the General Committee of The Order
of Railroad Telegraphers on the Chicago, Rock Island and Pacific Railroad
that:
1. Carrier violated, and continues to violate, the agreement
between the parties hereto when, beginning on or about November
27, 1956 and continuing almost daily thereafter, at its Amarillo, Texas
yard office, it requires or permits employes not within the scope of
the said agreement to handle by telephone matters or messages of
record, and that
2. Carrier shall now be required to pay Claimant T. F. Brantley,
first shift telegrapher at its Amarillo, Texas, Passenger station, and
his relief or successor, one call under the applicable rules of the prevailing agreement, for each occasion Carrier has required or permitted
employes not within the scope of the said agreement to perform the
work here involved.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing was waived and under date of December 19, 1958, the
parties jointly addressed a formal communication to the Secretary of the
Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Claim dismissed.
