PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
THE BALTIMORE AND OHIO RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on The Baltimore and Ohio Railroad, that:
1. Carrier violated the agreement between the parties hereto
when on November 29, December 1, 2, 4, 10, 14, 20, 26, 1956, and
January 26 and 27, 1957, it caused, permitted and required train or
engine service employes not covered by the Telegraphers' Agreement,
on trains in the passing siding at Fenelton, Pennsylvania, to report
over the telephone at Fenelton to the operators at Craigsville, Cowan
or WS Tower, Pennsylvania, the time trains they were meeting at
Fenelton passed that point, and to secure from the operator at Craigs-
ville, Cowan or WS Tower Clearance Card Form A, Part 4, giving
them permission to re-enter the main track at Marion Center and
proceed east.
2. Carrier shall now compensate the following employes for pay
for one day on the dates listed below:
R. W. Weaver, November 29, 1956
W. G. Black, December, 1956
C. B. Parsell, December 2, 1956
W. W. Berfeld, December 4, 1956
E. E. Aurand, December 10, 1956
H. G. Bargerstock, December 14, 1956
E. D. Gallman, December 20, 1956, and
idle employes, extra in preference, on December 26, 1956 and January
26 and 27, 1957.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing was waived and under date of January 19, 1959, the parties
separately addressed formal communications to the Secretary of the Third
Division requesting withdrawal of this case, which request is hereby granted.
