PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
HUDSON & MANHATTAN RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Hudson and Manhattan Railroad, that:
1. The Carrier violated the agreement between the parties
when on October 1, 1956, it declared abolished the position of
Record Clerk and transferred the work to employes and officials not
covered by the agreement.
2. Carrier shall restore the work of the position .to employes
under the agreement and compensate Joan Sporer, regularly assigned occupant of the position, for all wages lost as a result of this
violative action of the Carrier.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing was waived and under date of April 7, 1959, the parties
jointly addressed a formal communication to the Secretary of the Third
Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Claim dismissed.
