THIRD DIVISION
PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
HUDSON & MANHATTAN RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Hudson and Manhattan Railroad, that:
1. Carrier violated the agreement between the parties when
it failed and refused to apply wage adjustments and other benefits
to positions classified as draftsmen.
2. Carrier shall properly compensate: A, Rubino from
September 26, 1955 to November 2, 1956; W. Marallo from November 14, 1955 to August 28, 1956; A. Weber from October 3, 1956
to December 29, 1956 for all wage adjustments and other benefits
accruable to them under applicable rules.
3. Carrier shall apply all wage adjustments and other benefits
to the positions and compensate employes occupying the positions
accordingly.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing was waived and under date of April 7, 1959, the parties
jointly addressed a formal communication to the Secretary of the Third
Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Claim dismissed.
