PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
SOUTHERN RAILWAY COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Southern Railway, that:
1. Carrier violated the Telegraphers' Agreement, when on
17th day of August 1957, it caused, required or permitted Conductor
Grove of Work Extra 4131, an employe not covered by the Telegraphers' Agreement, to handle (receive, copy and deliver) train
order No. 590 at Bluff City, Tennessee.
2. Carrier shall compensate C. H. Foster, agent-telegrapher,
Bluff City, Tennessee, for one call (two hours and forty minutes)
under Rule 10 at the rate of one and one-half times the pro rata
rate of $2.1050 per hour. Total amount due $8.42.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of June 8, 1959,
the complainant party addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Claim dismissed.
