PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MISSOURI PACIFIC RAILROAD COMPANY-Gulf District
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Missouri Pacific Railroad, (Gulf
District,) that:
1. Carrier violated Agreement between the parties when on
April 16, 17, 18, 19, 20, 23, 24, 1956, it required or permitted
Foreman N. J. Prejean, an employe not covered by Telegraphers'
Agreement, to copy train lineups at Port Barre, Louisiana.
2. Carrier shall be required to compensate E. J. Richard for
one call (each day) ($6.21) for violations on April 16 and 23,
1956; total $12.42.
3. Carrier shall be required to compensate N. D. Watson for
one call (each day) ($6.21) for violations on April 17, 18, 19,
20, 24, 1956;
4. Carrier shall be required to permit joint check of records
to determine subsequent violations at Port Barre, Louisiana, in
the manner set forth in Paragraph 1; to permit joint check of
records to determine the names and amounts due employes covered
by our Agreement for such subsequent violations, if any be found.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing thereon has been held and concluded. Under date of July
1, 1959, the parties jointly addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case from further
consideration by the Division, which request is hereby granted.
