PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MISSOURI PACIFIC RAILROAD COMPANY-Gulf District
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Missouri Pacific Railroad, (Gulf
District,) that:
1. Carrier violated the Agreement when it failed and refused .to compensate L. H. Bradley, at the time and one-half rate,
for services rendered on April 25 and 26, 1957 at Spring, Texas.
2. Carrier will be required to compensate L. H, Bradley for
the difference between the pro rata rate paid and the time and
one-half pro rata rate which should have been paid, for services
rendered on April 25 and 26, 1957 at Spring, Texas.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing was waived and under date of July 1, 1959, the parties
jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Claim dismissed.
