PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MISSOURI PACIFIC RAILROAD COMPANY-Gulf District
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Missouri Pacific Railroad, (Gulf
District,) that:
1. Carrier violated the Agreement in failing and refusing to
allow C. B. Bergeron, who was on vacation June 26 to July 14, 1957,
inclusive, proper compensation in accordance with Agreement rules
for such vacation period.
2. Carrier shall now be required to pay C. B. Bergeron, in addition to amount heretofore allowed, an additional sum equivalent
to eight (8) hours at time and one-half pro rata rate for such
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing was waived and under date of July 1, 1959, the parties
jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Claim dismissed.
