PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
THE NEW YORK, NEW HAVEN AND HARTFORD RAILROAD
COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the New York, New Haven and Hartford
Railroad, that:
1. Carrier violated the agreement between the parties when on
March 31, 1958 it discontinued the position of first trick Signal
Station Operator Clerk at Canton Junction passenger Station, discontinued the position of Agent at Canton Junction freight house
and created a new position under the title of Agent-Signal Station
Operator covering the same class of work.
2. Carrier shall be required to restore the discontinued positions to their status prior to March 31, 1958 and restore the
regularly assigned incumbents thereof to the positions (Milton
Reynolds to the first trick Signal Station Operator-Clerk position
and R. A. Birman to the Agent position).
3. Carrier shall be required to compensate Milton Reynolds
and R. A. Birman for all wages lost from March 31, 1958 until
restored to their regular positions.
4. Carrier shall be required to compensate the senior idle extra
operator, on the seniority district, in the amount of a day's pay
on each day commencing March 31, 1958 and continuing thereafter
until the violation is corrected.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of July 14, 1959,
the parties jointly addressed a formal communication to the Secretary of the
Third Division requesting withdrawal of this case, which request is hereby
granted.
