STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad 'Telegraphers on The New York, New Haven and Hartford
Railroad, that:
1. The Carrier violated the provisions of the agreement between the parties when, commencing on Monday, October 7, 1957
and continuing on subsequent dates, it required or permitted the
conductor of Crane H-55 to report times of arrival and departure
of his train, obtain permission to occupy the block and to copy motor
hand car messages at Middlefield, Connecticut.
2. The Carrier shall be required to compensate J. S. Hills
or other senior idle telegraphers, extra in preference, who may be
determined to be entitled, for eight hours on each day commencing
October 7, 1957 and continuing thereafter until the violation ceased.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex
parte by the complainant party; and
That no hearing thereon has been held, and under date of July 14, 1959,
the parties jointly addressed a formal communication to the Secretary of the
Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Claim dismissed.
