STATEMENT OF CLAIM:
Claim of the General Committee of the Order
of Railroad Telegraphers on the Pennsylvania Railroad Company that,
"Time Claim filed by A. W. Yoho, Block Operator, for 8 hours'
compensation June 1, 1954, account EP-2 Engine 9666 receiving
permissive block at Roemer with
permissive Form
K by "GS" at 9:27
P. M. Crew called Operator at
Roemer on
wayside phone from
Wheatland. Operator at Roemer was instructed by Dispatcher to
change block to clear to "GS" and Form K, clear, by "GS" at 11 :44
P. M."
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was
certified to
the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has
been held
and concluded. Under date of August
13, 1959, the parties jointly addressed a formal communication to the
Secretary
of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
