STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Pennsylvania Railroad, that:
Nick Homick, extra Block Operator, was available but not used
to work the Operator-Clerk's position at Allen Lane on August 26,
31, September 1, 2, 7, 9, 14, 15, 16, 21, 29, 1953, and instead train
service crews were required to operate switches and perform other
block operator duties at Allen Lane in violation of the Scope of the
Telegraphers' Agreement. Nick Homick submitted time cards for
each date claiming 8 hours pay which was denied.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of August
13, 1959, the parties jointly addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
