THE PENNSYLVANIA RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Pennsylvania Railroad Company that:
Nick Hommick, Extra Block Operator, was available and not
used to perform block operator service at Wawa on August 28, 31,
and September 1, 2, 6, 7, 13, 14, 15, 16, 20, 21, 22, 27, 29, 1958,
but instead train service crews were required to operate the switches
and perform all other block operator duties at Wawa formerly performed by the Block Operators in violation of the Telegraphers'
Agreement.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of August
13, 1959, the parties jointly addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
