STATEMENT OF CLAIM: Claim of the Order of Railroad Telegraphers on the Pennsylvania Railroad Company, Cincinnati Division that:
On Saturday, September 26, 1953, the Agency at Norwood
Freight Station was changed from a five-day position to a six-
day assignment, and that an employe not covered by the Agents
Agreement was assigned to work on Saturday and to perform work
that is normally performed by the Assistant Agent when he is on
duty. A change in the relief days of the employe not covered
by the Agent's Agreement was made to fill the position on Saturday. Claim is hereby made for pay on a call and overtime basis
for J. M. Sigler equal to the hours worked by the employe used
to cover this assignment on Saturday, September 26, 1953 and
for each subsequent Saturday this method of filling the position
is permitted.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of
August 13, 1959, the parties jointly addressed a formal communication
to the Secretary of the Third Division requesting withdrawal of this case
from further consideration by the Division, which request is hereby granted.
Claim dismissed.
