STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers that the Agreement was violated when the Assistant Agent's position was abolished at Fourth Ave., Pittsburgh, without abolishing the work of the position. Also, that the performance of the work by an employe not under the coverage of the Agreement is a violation of the Scope Rule of the Agreement. Claim is made that R. A. Franks be restored to the position and compensated for any loss of pay or expense incurred because of this arbitrary action, and that any other employes who were improperly displaced or caused loss when R. A. Franks was compelled to exercise his seniority be compensated for such loss or expense.
That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of August 13, 1959, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
