THE PENNSYLVANIA RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of The Order of Railroad Telegraphers that:
D. D. Rothenberger has been improperly removed from his
position as Agent at Manayunk and instructed to exercise his
seniority in the clerical forces. Rothenberger to be restored to
his position with seniority unimpaired and to be reimbursed for
all losses in pay, plus any expense incurred as a result of the Carrier's
action.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That bearing thereon has been held and concluded. Under date of
August 13, 1959, the parties jointly addressed a formal communication
to the Secretary of the Third Division requesting withdrawal of this case
from further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
