STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Norfolk Southern Railway that:
1. The Carrier shall be required to reimburse Telegrapher
E. W. Yountz for the following expenses:
4 nights' lodging . . . . . . . . . . . . .. . . .. . . . . . . . . . $ 4.00
12 meals @ $1.00 each 12.00
35 miles, auto mileage @ 6c per mile ....... 2.10
Total Expenses $15.10
which were incurred by the claimant when the Carrier violatively
removed him from his assignment as agent-operator, Bailey, N. C.,
September 21, 22, 23 and 24, 1955, and required him to travel to and
work the first shift operator's position at Glenwood Yard, Raleigh,
N. C., on these dates.
2. The Carrier shall be required to reimburse Telegrapher
M. S~. Chamblee for the following expenses:
Breakfast, 12 days @ 60c each $ 7.20
Luneb, 12 days @ 75c each 9.00
Dinner, 15 days @ 75c each 11.25
Lodging, 12 days @ $1.25 each 15.00
Total Expense $42.45
which were incurred by the claimant when the Carrier violatively removed him from his assignment as first shift operator, Glenwood
Yard, Raleigh, N. C., September 21, 1955 to October 9, 1955, and
required him to travel to and work the second shift operator-leverman's position at Wilson, N. C., during this period.
FINDINGS:
The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing was waived and under date of September 21, 1959 the
parties jointly addressed a formal communication to the Secretary of the Third
Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Claim dismissed.
