PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
THE LOUISVILLE AND NASHVILLE RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violated the Clerks' Agreement when, on
January 9, 1956, it posted a Notice in the Auditor of Freight
Accounts' Office announcing it would give "a course of instruction in the fundamentals of tariff interpretation and the application and division of rates," the classes to be held outside of working hours and the time of the employes spent in classes to be without compensation.
(b) The employes accepted and assigned to the "course of
instruction" be compensated at the rate of time and one-half the
rate of their present positions for four (4) hours each Saturday,
beginning with January 28, 1956, and subsequent thereto, on
which they were in attendance thereat.
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the
whole record and all the evidence, finds and holds:
That carrier and employes involved in this dispute are respectively
carrier and employes within the meaning of the Railway Labor Act, as
approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing thereon has been held and concluded. Under date of
October 19, 1959, the parties jointly advised the Secretary of the Third Division of their desire to withdraw this case from further consideration by the
Division, which request is hereby granted.
