PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
ST. LOUIS-SAN FRANCISCO RAILWAY COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the terms of the currently effective
Agreement between the parties when on January 31, 1958 it normally abolished the position of Messenger in the Relay Office at
Tulsa, Oklahoma in the seniority district of the General Manager
and unilaterally and arbitrarily assigned the work thereof to Wire
Chiefs
in the Relay Office at Tulsa, the Station Janitor in another
seniority district, and other clerical employes in the seniority district
of the Tulsa Terminal.
· (2) Mrs. Ruth Coop now be allowed one day's pay at the rate
of the Messenger Position, February 3, 1958 and each date thereafter until corrected, and the work restored to the seniority district
of the General Manager.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex pane by the complainant party; and
That no hearing thereon has been held, and under date of October 20,
1959 the parties jointly advised the Secretary of the Third Division of their
desire to withdraw this case, which request is hereby granted.
AWARD
Case dismissed.
