FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
ST. LOUIS-SAN FRANCISCO RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the terms of the currently effective
Agreement between the parties when on or about April 21, 1958, it
abolished the entire clerical force in the Yard Office at Lindenwood
in the St. Louis Terminal and distributed a part of the work thereof
to employes covered by an Agreement with another craft who hold
no seniority or other rights under the Clerks' Agreement.
(2) That the clerical work unilaterally removed from the
clerical workers be returned to them.
(3) W. O. Hesley, A. Depke, Joseph Schaya, Clyde Hall, Ben
Thomas, C. Swearingim, Matt Dochnal, William Bell, Raymond
Morse, and John Bishop now be reimbursed for all losses sustained
as a result of this violation.
Note: Wage losses sustained by employes to be determined by joint check of Carrier's payrolls and other necessary records.
FINDINGS:
The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon and upon the whole
record and all the evidence, finds and holds:
That carrier and employes involved in this dispute are respectively carrier
and employes within the meaning of the Railway Labor Act, as approved June
21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and

That hearing thereon has been held but not concluded. Under date of
October 20, 1959, the parties jointly advised the Secretary of the Third Dir-ision of their desire to withdraw this case from further consideration by the
Division, which request is hereby granted.
AWARD
Case dismissed.
