FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
THE CHESAPEAKE AND OHIO RAILWAY COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violated the Agreement when it failed
to properly pay Janitor C. M. Jackson at Clifton Forge, Virginia,
for service required of him on his rest day, Sunday, May 18, 1958.
(b) Janitor C. M. Jackson shall now be paid eight hours
at rate of time and one-half in addition to eight hours pro rata
paid for work performed on Monday, May 19, 1958.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of December 4,
1959 the parties jointly advised the Secretary of the Third Division of their
desire to withdraw this case, which request is hereby granted.
AWARD
Case dismissed.
