STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(a) Carrier violated the
Agreement between
the parties
when in changing the assigned rest days of D. R. Killion, Bill
Clerk Position 4015, Ottawa, Kansas, it did not permit him to work
the position June 2, 1958; and,
(b) Carrier shall now compensate Claimant Killion for eight
(8) hours at straight time rate for June 2, 1958.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing
thereon has
been held, and under date of December 15,
1959, the complainant party
addressed a
formal communication to the Secretary of the Third Division requesting withdrawal of this case, which
request is
hereby granted.
AWARD
Case dismissed.
