PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Missouri Pacific Railroad that:
1. Carrier violated the Agreement between the parties when
on July 22, 1957 it arbitrarily reduced the rate of pay on the
position of telegrapher-cashier at Bush, Illinois, without negotiating
a new rate with The Order of Railroad Telegraphers.
2. Carrier shall restore the proper rate to the position
pending negotiation of a new rate.
3. Carrier shall compensate F. O. Cole, and any and all
other incumbents of the position, for the difference in the amount of
pay allowed and the amount due under the negotiated rate for each
day the position is worked at the contested rate.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing was waived and under date of December 31, 1959, the
parties jointly addressed a formal communication to the Secretary of the
Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Claim dismissed.
