PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MISSOURI ILLINOIS RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Telegraphers on the Missouri-Illinois Railroad, that:
1. Carrier violated the Agreement between the parties when it
refused and continues to refuse to permit Telegrapher W. S. Hawley
to exercise his seniority and displace on the agency at Ste. Genevieve, Missouri on January 25, 1958.
2. Carrier violated the Agreement between the parties when
it allowed Telegrapher W. S. Hawley to displace Telegrapher-Clerk
G. H. DeRousse at Centralia, Illinois on January 25, 1958 instead of
exercising his seniority on the agency at Ste. Genevieve, Missouri.
3. Carrier shall now compensate W. S. Hawley the difference
between the amount due him at the Ste. Genevieve agency rate
and that paid him as telegrapher-clerk at Centralia from January 25,
1958 until he is properly assigned to the Ste. Genevieve agency.
4. Carrier shall now compensate G. H. DeRousse the difference
between the amount due him at the Centralia telegrapher-clerk rate
and the amount paid him on the extra board beginning with January
25, 1958 until he is properly restored to his rightful position of
telegrapher-clerk at Centralia, Illinois.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing was waived and under date of December 31, 1959, the
parties jointly addressed a formal communication to the Secretary of the
Third Division requesting withdrawal of this case, which request is hereby
granted.
